Filing 13 ORDER OF SEVERANCE The Clerk of Court is directed to SEVER the claims of Gregory Joseph Nelson into a new case. The Clerk will open a new civil action and will docket, in that action, the amended complaint (Dkt. #11 in this action) and acopy of this Order, with Plaintiff Nelson as the sole plaintiff in the new case. Plaintiff Nelson is TERMINATED as a party to the instant action, which will proceed with Plaintiff Ayala as the sole plaintiff. Each Plaintiff's complaint will relate back to the filing date of the original complaint in this action, to avoid a statute of limitations problem that might result from a new filing date. No additional filing fee will be required. The instant case and the new case opened in accordance with this Order remain subject to initial review, or screening, by the Court under 28 U.S.C. 1915 and 1915A. Screening orders will be issued at a later date. Because Plaintiff Ayala has already filed an amended complaint, found at Docket No. #11 , his Motion for Enlargement of Time to File Court-Ordered Amended Complaint (Dkt. #12 ) is MOOT.
