File a motion to proceed on appeal in forma pauperis with the Court of Appeals, with proof of service on your opponent. Further, this appeal is subject to the Prison Litigation Reform Act. TEXT ORDER entered by Judge Harold A. Baker on 8/25/2020. Plaintiff has filed a petition for leave to appeal in forma pauperis and memo explaining his grounds for appeal. 28 U.S.C. Sec 1915(a)(3) provides that "an appeal may not be taken in forma pauperis if the trial court certifies in writing that it is not taken in good faith." An appeal taken in "good faith" is not about the movant's sincerity or motivation. A good faith appeal is an appeal that "a reasonable person could suppose... has some merit" from a legal perspective. Walker v. O'Brien, 216 F.3d 626, 632 (7th Cir. 2000). Upon review of the record, the Court sees no good faith grounds for appeal within the meaning of 28 U.S.C. Sec 1915(a)(3). The Court is already determining whether Plaintiff is in imminent danger in case 20-1245. If Plaintiff needs to supplement his imminent danger allegations in case 20-cv-1245, he may do so. The Court certifies that Plaintiff's appeal is not in good faith within the meaning of 28 U.S.C. Sec 1915(a)(3). Accordingly, Plaintiff's petition to proceed in forma pauperis on appeal is denied. #9 . If Plaintiff wishes to contest this court's finding, he must renew his petition to proceed in forma pauperis with the Court of Appeals within 30 days after service of this order.
