TEXT ORDER entered by Judge Sue E. Myerscough on 7/30/2021. Plaintiff has not signed her complaint. By August 20, 2021, Plaintiff is directed to file a signed complaint or this case will be dismissed without prejudice and no filing fee will be assessed. Plaintiff is advised that, if she submits a signed complaint, the $350.00 filing fee will be taken from her prison account in installments, even if this case is dismissed before service for failure to state a claim. Plaintiff is further advised that a Fourth Amendment claim for arrest without probable cause requires facts that allow an inference that no probable cause existed to arrest a person for any crime, not just the crime charged. McComas v. Brickley, 673 F.3d. 722, 727 (7th Cir. 2012)("'an arrest is reasonable under the Fourth Amendment so long as there is probable cause to believe that some criminal offense has been or is being committed, even if it is not the crime with which the officers initially charge the suspect.'"). Additionally, damaging a citizen's reputation with false or incorrect information is generally not a federal claim. Swanigan v. City of Chicago, 881 F.3d 577 (7th Cir. 2018)(no constitutional claim for information in police folder in closed case falsely linking arrestee to robberies). (KB) |
