Date Filed Document Text
April 4, 2022 Filing 13 MOTION to Re-Open Case by Petitioner Darnell Tipton. Responses due by 4/18/2022 (AEM)
April 4, 2022 Opinion or Order TEXT ORDER denying #13 Motion entered by Judge Joe Billy McDade on 4/4/2022. In the instant Motion, Petitioner continues to restate the same arguments raised in his earlier filings and suggests he has been treated badly by the justice system due in part to his race. Nothing in this filing negates the fact that the Court cannot consider Petitioner's successive request for habeas relief absent leave from the Seventh Circuit, see 28 U.S.C. 2244(b)(3)(A), which Petitioner has seemingly made no attempt to obtain. This case is terminated, and there is no argument available to Petitioner that will change that outcome. He is therefore warned that further attempts to litigate this case will result in sanctions. (EWL)
March 28, 2022 Opinion or Order TEXT ORDER denying #12 Motion entered by Judge Joe Billy McDade on 3/28/2022. The Court construes the instant Motion as a motion to reconsider. The Motion does not identify any manifest error of law or fact that would have altered the outcome of the requisite merit review; it merely restates the same factual arguments the Court considered in the merit review. Accordingly, the Motion must be denied. See Hicks v. Midwest Transit, Inc., 531 F.3d 467, 474 (7th Cir. 2008) ("Motions for reconsideration serve a limited function[:] to correct manifest errors of law or fact or to present newly discovered evidence." (internal quotation marks omitted)). This case remains TERMINATED. (EWL)

March 23, 2022 Filing 11 JUDGMENT in a Civil Case. (AEM)
March 22, 2022 Opinion or Order Filing 10 ORDER Entered by Judge Joe Billy McDade on 3/22/2022. IT IS THEREFORE ORDERED that the Petition under 28 U.S.C. 2254 #1 is DISMISSED. All motions currently pending are DENIED AS MOOT. As no reasonable jurist could find this decision debatable, the Court declines to issue a certificate of appealability. The Clerk is directed to promptly notify Petitioner of this decision. (AEM) Modified on 3/23/2022 (AEM).
March 18, 2022 Filing 9 Letter from Darnell Tipton. (AEM)
March 18, 2022 Prisoner Filing Fee Paid 3/18/2022, in the amount of $ 5.00; receipt number 14626042746 (AEM) Modified on 3/31/2022 (AEM).
March 10, 2022 Filing 8 Letter from Darnell Tipton. (AEM)
March 10, 2022 Opinion or Order TEXT ORDER entered by Judge Joe Billy McDade on 3/10/2022. Petitioner has filed several documents. However, he has not paid the filing fee in accordance with the Court's Text Order dated 2/25/2022. The Court will not consider any of Petitioner's filings until he pays his filing fee, which is due on or before 3/18/2022. (EWL)

February 25, 2022 Opinion or Order TEXT ORDER denying #2 Motion for Leave to Proceed in forma pauperis entered by Judge Joe Billy McDade on 2/25/2022. Though Petitioner fails to provide the requisite statement of his institutional account, his filing #3 indicates he has $1687.00 in his institutional account and is therefore able to pay the $5.00 filing fee in this case. He is therefore ordered to remit payment within 21 days of the date of this Text Order. (EWL)
