December 3, 2024 Opinion or Order TEXT ORDER: On 10/28/2024, the Court granted the Plaintiff leave to re-file, within 30 days, an Application to Proceed in District Court Without Prepaying Fees or Costs with more relevant financial information and to amend his Third-Party Complaint. The Court ordered, in the alternative, that the Plaintiff pay the $405 filing fee within 30 days if he wished to proceed with this case. The Plaintiff has filed nothing further in this case, nor has he paid the $405 filing fee. The Plaintiff must re-file his Application to Proceed in District Court Without Prepaying Fees or Costs with more relevant financial information AND amend his Third-Party Complaint by 12/17/2024, or he must pay the $405 filing fee by 12/17/2024. Failure to comply with this Text Order will result in dismissal of this case. The Clerk is directed to send a copy of this Text Order to the Plaintiff. October 28, 2024 Opinion or Order TEXT ONLY ORDER entered by Judge James E. Shadid on 10/28/2024. Robert W. Johnson has filed a Third-Party Complaint and Application to Proceed in District Court Without Prepaying Fees or Costs. The Court reviews Johnson's application under 28 U.S.C. Section 1915, designed to ensure indigent litigants meaningful access to the federal courts. See Neitzke v. Williams, 490 U.S. 319, 327 (1989). The court must deny an application if: (1) the allegation of poverty is untrue; (2) the action is frivolous; (3) the action fails to state a claim; or (4) the action seeks monetary relief against an immune defendant. 28 U.S.C. Section 1915(e)(2). In his application, Johnson attests to having no savings and no incomes for the past 12 months and answers "N/A" to the remaining questions relating to his living expenses and other financial obligations or supports. This causes the Court to question the accuracy and, perhaps, the veracity of the application. Moreover, Johnson's Third-Party Complaint appears beyond frivolous as Johnson signs it both as an attorney for himself and as a representative of Plaintiff Warner Music Group Inc. This is improper. The Court also cannot make out what it is that he claims to have happened or what relief he is seeking before the Court. For these reasons, the Court denies Johnson's application, with leave to re-file, within 30 days, to provide more relevant financial information and to amend his Third-Party Complaint. In the alternative, Johnson must pay the $405.00 filing fee within 30 days if he wishes to proceed with this case. The Court admonishes Johnson that answers in the application to proceed without prepaying fees or costs are submitted to the Court "under penalty of perjury" and that the improper signing or filing of other pleadings or papers before the Court may result in sanctions under Federal Rule of Civil Procedure 11.(BMG)
