On July 14, 2020, the Court entered an order directing Plaintiff to either pay the filing fee or petition the Court to proceed in forma pauperis by August 4, 2020. The following day, the Court entered a Merit Review Order that reiterated its direction to Plaintiff regarding his filing fee obligation. To date, Plaintiff has not complied with the Court's Orders. The Court sua sponte GRANTS Plaintiff an additional fourteen days from the entry of this Order, to either pay the $400 filing fee or file a petition to proceed in forma pauperis. July 15, 2020 Opinion or Order Filing 3 MERIT REVIEW ORDER entered by Judge James E. Shadid on 7/15/2020. Pursuant to its merit review of Plaintiff's complaint under 28 U.S.C. Sec 1915A, the Court finds that Plaintiff has alleged enough facts to proceed with his Fourteenth Amendment objective unreasonableness claim and a First Amendment retaliation claim against Defendant Shelly. Plaintiff's claim against Shelly proceeds in her individual capacity only. Any additional claims shall not be included in the case, except at the Court's discretion on motion by a party for good cause shown or under Federal Rule of Civil Procedure 15. Plaintiff has up to and including July 29, 2020, to either pay the $400 filing fee or file a motion for leave to proceed in forma pauperis. If Plaintiff does not comply with the Court's July 29, 2020, deadline, or request an extension of time on or before that date, the Court will dismiss this case without prejudice. The Court directs the Clerk to enter the standard qualified protective order under the Health Insurance Portability and Accountability Act. Plaintiff has filed a Complaint but has not paid the $400 filing fee nor filed a petition to proceed in forma pauperis. Within 21 days of the entry of this order, Plaintiff must pay the $400 filing fee in full or file a petition to proceed in forma pauperis with attached trust fund ledgers for the last 6 months. Failure to comply without good cause will result in dismissal of this case without prejudice, and the Plaintiff will still be responsible for payment of the filing fee. See 28 U.S.C. Sec. 1914.
