TEXT ORDER: Petitioner's Motion for Leave to Proceed in forma pauperis #2 is DENIED. While Petitioner states in his motion that he has received no income, including no income from gifts in the last 12 months, his trust fund ledger reveals $230.00 has been deposited into his account in the past two months. While some of this money appears to have covered medication, the majority has been spent at the commissary. Accordingly, the Court finds that Petitioner has had sufficient funds available to pay the $5.00 filing fee.
