The Court concludes that the dispute between the Parties is not subject to arbitration. The Court notes that there was a discovery dispute between the parties while the summary judgment motions were pending. Discovery was stayed pending resolution of the summary judgment motions. Accordingly, this case is referred to United States Magistrate Judge Tom Schanzle-Haskins to address any discovery issues in light of the Court's ruling. (See Written Opinion.)
