April 6, 2020 Opinion or Order TEXT ORDER denying #6 Motion entered by Judge Joe Billy McDade on 4/6/2020. On 3/12/20 Defendants County of Logan, Sheriff Mark Landers and Captain Mike Block, filed a Notice of Removal of this case from Illinois State Court in the Circuit Court of Logan County to the Federal Court in the Central District of Illinois. Defendants assert that the Notice of Removal was filed with the consent of the other Defendants; Advanced Correctional Healthcare and Amy Woodrum who have been served. Defendants assert that the Notice was timely as it was filed within 30 days of Plaintiff's 2/28/20 filing of the amended complaint and the 2/254/20 service on Defendants. See 28 U.S.C. 1446(b). Plaintiff files #6 , captioned a Petition for Injunctive Relief, which is actually an objection to Defendants' Notice of Removal. Plaintiff asserts that his amended complaint does not involve a federal question so as to invoke the Court's jurisdiction. Plaintiff does not provide a copy of his complaint and Defendants assert that it alleges violations of HIPAA Privacy, PREA Privacy violations, and "civil rights" violations regarding deliberate indifference to serious mental health needs. These appear to be federal questions over which the Court has jurisdiction. Plaintiff's #6 is to be amended and identified as a Motion in Opposition to Notice of Removal. #6 is DENIED. (SAG, ilcd)
