                TEXT ORDER entered by Judge James E. Shadid on 3/25/2020. Plaintiff is one of several named individuals in a lawsuit currently pending before U.S. District Court Judge Harold A. Baker which alleges IDOC has failed to provide proper diagnostic care and treatment for Hepatitis C inmates. See Orr, et. al. v. Elyea, et. al., Case No. 08-2232. Plaintiff has now filed a new complaint and motion for injunctive relief apparently seeking to bring his own case involving his recent care for Hepatitis C at Jacksonville Correctional Center. However, the Seventh Circuit recently reversed Judge Baker's grant of a preliminary injunction, concluding the evidence presented did not support a finding that inmates with a fibrosis level of 2, such as the Plaintiff, were likely to suffer irreparable harm. Orr v. Shicker, Appellate Nos. 19-1380, 19-1387, and 19-1732 (7th Cir. 2020). Therefore, Plaintiff's motion for preliminary injunction is denied based on the Appellate Court's finding. #5 . The clerk is directed to send a copy of the Seventh Circuit's order to Plaintiff. The Court will conduct a merit review of Plaintiff's complaint pursuant to 28 U.S.C. 1915A and Plaintiff will receive a copy of the Court's order when it is entered. (SAG, ilcd)

                TEXT ORDER granting #3 Petition to Proceed In Forma Pauperis. Pursuant to 28 U.S.C. Section 1915(b)(1), Plaintiff is assessed an initial partial filing fee of $3.25. The agency having custody of Plaintiff is directed to forward the initial partial filing fee from Plaintiff's account to the Clerk of Court. After payment of the initial partial filing fee (or immediately if no funds are available for that payment) the agency having custody of Plaintiff is directed to make monthly payments of 20 percent of the preceding month's income credited to Plaintiff's account to the Clerk of Court. Income includes all deposits from any source. The agency having custody of the plaintiff shall forward these payments each time Plaintiff's account exceeds $10, until the filing fee of $350 is paid in full.
