TEXT ORDER entered by Chief Judge Sara Darrow on 12/9/2020. On November 9, 2020, the Court struck Plaintiff's motion for leave to file a writ of mandamus #1 because he did not sign his pleading as required by Federal Rule of Civil Procedure 11 but granted Plaintiff twenty-one days to file a corrected pleading. The Court admonished Plaintiff that failure to timely comply would result in dismissal of this case. Thirty days have passed, and Plaintiff has not complied with the Court's order or move for an extension of time to comply. Therefore, the Court DISMISSES Plaintiff's case without prejudice. The Court deems moot all motions, deadlines, and hearings. Civil Case Terminated. (KE, ilcd) |
TEXT ORDER entered by Judge Harold A. Baker on 11/9/2020. The Court STRIKES Plaintiff's motion for leave to file a complaint for a writ of mandamus #1 because he has not complied with Federal Rule of Civil Procedure 11, which provides that "every pleading, written motion, and other paper must be signed by a party personally if the party is unrepresented." Fed. R. Civ. P. 11(a). Plaintiff's filing lacks his signature. The Court also DENIES Plaintiff's motion to enter Defendants #4 . The Court admonishes Plaintiff that any amended pleading he files must contain all allegations against all Defendants. Piecemeal amendments are not accepted. The Court GRANTS Plaintiff twenty-one days to resubmit an amended pleading. Failure to comply will result in the dismissal of Plaintiff's case. (KE, ilcd) |
