TEXT ORDER entered by Judge James E. Shadid on 4/14/2021. Plaintiff has filed a complaint with full payment of the $402 filing fee #1 . Plaintiff has also filed a motion to reconsider noting this is the second time he has filed the same claims #4 . In Dyjak v. Austin, Case No. 21-cv-3012 (SEM), Plaintiff's motion to proceed in forma pauperis was denied because he failed to disclose funds which could have been used to pay the fee. Plaintiff was advised the case was dismissed "without prejudice to refiling as a new case with payment of the $402 filing fee." See February 17, 2021, Text Order. Since Plaintiff has paid the fee in this case, he may proceed with his lawsuit and the motion to reconsider is denied as moot #4 . However, Plaintiff is reminded he is still responsible for full payment of the filing fee in his previous lawsuit, Dyjak, Case No. 21-3084. Plaintiff will receive a copy of the Merit Review Order in this case when it is entered. (SAG)
