Filing 41 ORDER & OPINION Entered by Judge Joe Billy McDade on 5/22/15. The complaint is dismissed for failure to state claims for which relief can be granted as well as failing to comply with Federal Rule of Civil Procedure 9(b). A review of the docket shows that Relator has not previously amended his complaint. Therefore, the Court finds it appropriate to grant Relator leave to amend his complaint to address the deficiencies and problems described in this Order and Opinion. Relator may amend his complai nt within twenty-eight days (28) of the date of this Order. Defendant may then file a responsive pleading or an appropriate motion within twenty-one (21) days thereafter. Should Relator fail to amend his complaint within the time allotted, the Court will dismiss this action with prejudice. IT IS THEREFORE ORDERED that Defendant's Motion to Dismiss 37 is GRANTED.(SW, ilcd) |
