February 25, 2016 Opinion or Order Filing 11 ORDER entered by Judge Sara Darrow on February 25, 2016 GRANTING Plaintiff's #10 Motion for Entry of Default. Default is entered against the defendants Mitchell V. Rampley, Tammy L. Rampley and JP Morgan Chase, Successor to Providian National Bank, their failure to appear, answer, or otherwise plead in this cause in the time and manner as provided by the Federal Rules of Civil Procedure and the Rules of this Court. This cause of action is subject to dismissal for failure to prosecute unless within 14 days of the entry of this Order of Default, the United States of America makes application to the District Court for the entry of a default judgment. (SC, ilcd)
February 23, 2016 On 12/14/2015, an incorrect docket entry "waiver of service returned executed as to JP Morgan Chase" was entered by plaintiff's counsel, which established an incorrect answer deadline for JP Morgan Chase of 10/23/15. Plaintiff's counsel contacted the clerk's office to let them know that in fact JP Morgan did not accept service by waiver and that a summons had been issued; this summons was issued by the clerk's office, but inadvertently never docketed. The 12/14/15 entry was actually a return of summons executed, which would make the correct answer deadline for JP Morgan Chase 12/25/15. The answer deadline has been correct to reflect the correct date of 12/25/15 for JP Morgan Chase. (MC, ilcd)
