Coar on 12/8/2010: Plaintiff is given leave to file his amended complaint. 6 Pursuant to Rule 15(a), the Clerk shall add a second defendant Hand as a defendant and terminate Dr. Unknown Psychological Worker, Dr. Ledvora, Dr. Patel and Medical Director as defendants without prejudice. Plaintiff may proceed with his claims against the terminated defendants in a separate action. The clerk is directed to issue summonses for service on the defendants Wilburn, Martaree, Patton, Hand and Hand by the U.S. Marshal. The clerk is further directed to send the plaintiff a Magistrate Judge Consent Form and Instructions for Submitting Documents along with acopy of this order. September 20, 2010 Opinion or Order Filing 4 WRITTEN Opinion Signed by the Honorable David H. Coar on 9/20/2010: Plaintiff's motion for leave to proceed in forma pauperis # 3 is granted. The Court orders the trust fund officer at Plaintiff's current place of incarceration to deduct & #036;3.33 from Plaintiff's account for payment to the Clerk of Court as aninitial partial filing fee. The Clerk shall send a copy of this order to the Supervisor of Inmate Trust Fund Accounts, Cook County Dept. of Corrections Administrative Offi ce, Division V, 2700 S. California, Chicago, Illinois 60608. However, summonses shall not issue at this time. The Court dismisses the complaint on file without prejudice. Plaintiff is granted thirty days in which to submit an amended complaint (plus a judge's copy and service copies). Failure to submit an amended complaint within thirty days of the date of this order will result in summary dismissal of this case.
