Filing 45 MEMORANDUM Opinion and Order written by the Honorable Matthew F. Kennelly on 9/29/2017: For the foregoing reasons, the Court denies Baggett's motion for discovery [dkt. no. 36]. The Court further directs the Clerk to enter judgment in favor of respondent on all of Baggett's claims [dkt. no. 1]. The Court declines to issue a certificate of appealability pursuant to 28 U.S.C § 2253(c)(2) because this Court's dismissal of Baggett's petition on procedural grounds is not debatable with respect to claims 1 through 4, and it is not debatable that petitioner fails to state a valid claim of the denial of a constitutional right in claim 5. See Slack v. McDaniel, 529 U.S. 473, 484-85 (2000). (pjg, ) |
