Plaintiff factually distinguishes the decisions cited by the Court for their general principles and contends that his motion to strike "was not premature but was required by Fed. Rule 12(a)(C)(1) [sic] which requires a Response to an Answer and Affirmative Defenses in 21 days or risk waiving any objections thereto." (Pl.'s Mot. Reconsider 2.) Plaintiff misconstrues Rule 12(a)(1)(C), which authorizes a reply to an answer only when the court orders a reply. The Court did not order a reply here, and all matters asserted in the answer and affirmative defenses are deemed to be denied or avoided by the plaintiff. Fed. R. Civ. P. 8(b)(6) ("If a responsive pleading is not required, an allegation is considered denied or avoided."). Accordingly, plaintiff's motion to reconsider #38 is denied. In several paragraphs of its answer that respond to plaintiff's allegations of injury, defendant asserts that the Court has dismissed plaintiff's claims for certain types of damages, and otherwise denies the allegations. Plaintiff argues that these statements should be stricken because plaintiff is entitled to seek these same damages in connection with other claims he has asserted. Plaintiff also argues that three of defendant's affirmative defenses should be stricken because defendant cannot "prove" them, or alternatively that they apply only to certain of plaintiffs claims. All of these arguments are premature and can be addressed at a later stage of the litigation. Motions to strike are disfavored generally, Custom Vehicles, Inc. v. Forest River, Inc., 464 F.3d 725, 727 (7th Cir. 2006), and usually "waste time by requiring judges to engage in busywork and judicial editing without addressing the merits of a party's claim," U.S. Bank National Association v. Alliant Energy Resources, Inc., No. 09-CV-078-bbc, 2009 WL 1850813, at *3 (W.D. Wis. June 26, 2009). That is the case here. Plaintiffs motion to strike #35 is denied.
