Cox: The Court has reviewed "Motion by Plaintiff Jeffrey Robert Sweet for attorney fees pursuant to 42 U.S.C. 406(b)(1), Unopposed" [25 and 26]. It does not appear from the body of the documents that Plaintiff's counsel contacted counsel for the Commissioner to determine whether the motion is truly unopposed, and nowhere other than on the face of the docket itself does it say that this motion is unopposed. Therefore, the Court sets the following briefing schedule on the same: the Commissioner is to file a response brief (or, if applicable, a short statement noting the motion is unopposed) by 3/22/2019. Plaintiff's reply brief is due by 3/29/2019; no reply is necessary if the Commissioner does not oppose the motion. The Court will rule by mail. No appearance is necessary on the motion. February 2, 2017 Opinion or Order Filing 8 ORDER: Plaintiff Jeffrey Robert Sweet's application to proceed in forma pauperis (ECF No. #4 ) is granted. Jeffrey Sweet last worked in 2007 and currently has no income except what he receives in food stamps. He resides with his father, a George Sweet, who "helps [him] financially." Jeffrey does not indicate what sort of financial help his father gives him. However, as he explicitly declares on the application that he is "unable to pay the $400 filing fee," the Court assumes that George Sweet's help does not extend to the payment of the prescribed court's fees. The Court thus finds that Jeffrey Sweet is unable to pay, and as his Social Security appeal does not appear frivolous, hereby grants his in forma pauperis motion. The parties are directed to confer and file a joint status report on or before 4/1/2017 which indicates: (1) whether an agreed remand order is necessary, (2) a proposed briefing schedule to resolve this appeal, and (3) whether the parties consent to the general jurisdiction of the magistrate judge. Signed by the Honorable Harry D. Leinenweber on 2/2/2017. Mailed notice (eaa, )
