MEMORANDUM Opinion and Order: The Court grants Ironshore's motion for summary judgment [dkt. no. 128]. Because the Court has determined Ironshore has no responsibility to indemnify Akorn's excess punitive damages, it follows that Ironshore did not breach the policy. The Court therefore denies the defendants' cross-motion for summary judgment [dkt. no. 138].5 The Court directs the Clerk to enter judgment in favor of the plaintiff and against the defendants.
