ORDER: Plaintiff David Gevas' motion to file an amended complaint #7 is granted. The Clerk of Court is directed to file the amended complaint #8 , issue summons for its service on William Brown, add William Brown as a Defendant, and terminate Ronald Brown, who Plaintiff initially named unintentionally. See Fed. R. Civ. P. 15(a)(1). Plaintiff's second motion to file an amended complaint #9 adding Ronald Gomez as a Defendant is stricken as moot, as this issue was resolved by the Court's order of August 23, 2018 #5 , in which the Court directed the Clerk to add Gomez as a Defendant on the docket. The U.S. Marshal Service shall serve, when completed service forms are received, Plaintiff's amended complaint on Defendants. The Clerk shall forward a copy of this order to the Marshal. ORDER: Plaintiff David Gevas' complaint may proceed against Stateville Correctional Center Officials Terrell Pork, Ralph Burkybile, Ronald Brown, Cynthia Garcia, Jose Becerra, and Jacquel Fisher. The Clerk of Court shall: (1) file Plaintiff's complaint #1 ; (2) issue summonses for service of the complaint on the above listed Defendants; and (3) send Plaintiff seven blank USM-285 service forms, a magistrate judge consent form, filling instructions, a copy of this order, and a certified copy of his complaint per his letter request to the Court. The Court advises Plaintiff that a completed USM-285 form is required for service on each Defendant. The U.S. Marshal will not attempt service on a Defendant unless and until Plaintiff has returned a completed service form. Plaintiff must therefore return the completed USM-285 forms to the Clerk in care of the Prisoner Correspondent within 35 days of this order. Failure to do so may result in the dismissal of any unserved Defendant, as well as dismissal of this case for lack of prosecution.
