Filing 12 MINUTE entry before the Honorable Edmond E. Chang: Status hearing held. Plaintiff's counsel reported that counsel for the Advanced Correctional Defendants stated that they will waive service by the end of this week. If service is not waived by 10/05/2018, then Plaintiff shall ask the Clerk, on 10/09/2018, to issue summons for service and Plaintiff shall effectuate service. The Court urges the Advanced Defendants to consider waiving service, because a refusal to waive service triggers a general requirement that Defendants pay the costs of service. Fed. R. Civ. P. 4(d)(2). The Kendall County Defendants' answers to the Complaint due 10/15/2018. Mandatory Initial Discovery Pilot Project disclosures due 11/14/2018. The first-round of written discovery must be issued no later than 12/14/2018. Fact discovery, including treating physicians (Rule 26(a)(2)(C) disclosures for any treaters are due no later than 60 days before the close of fact discovery), shall close by 05/31/2019. Any other Rule 26(a)(2) expert disclosures (whether retained or not) are due 30 days after the close of fact discovery, and the 30-day deadline is adjusted automatically if the close of fact discovery is adjusted. No summary judgment motions may be filed before the close of discovery without leave of Court. The parties shall work promptly on a HIPAA order and discovery confidentiality order.
