The Rule 8009(a)(1) designation and statement of issues generally should not take very long for any case, and certainly not what ended-up as a three-day bench trial, even with ancillary issues involved. And there is no need to review transcripts in order to accomplish the designation. Indeed, Rule 8009(b)(1)(A) expressly contemplates that transcripts will be *ordered* during the designation period, not that the transcripts will be read before the initial procedural step of filing the designati on and the issues statement. Because the deadline has already expired, however, the Court will extend the designation/statement deadline to 09/21/2018. The previously filed version of the motion #3 is terminated in light of the later version. The appellant's opening brief is due by 10/22/2018. The appellee's response brief is due by 11/21/2018. The appellant's reply is due by 12/05/2018. The status hearing of 10/18/2018 is reset to 10/26/2018 at 8:30 a.m. to track the filing of the opening brief (if it is filed on time, then the Court will reset the status).
