September 27, 2018 Filing 9 MINUTE entry before the Honorable Joan B. Gottschall: Plaintiff's motion to serve third party subpoena prior to a Rule 26(f) conference #5 is granted. No appearance is required on 10/10/18 to present the motion. Plaintiff is given leave to serve a Rule 45 subpoena on the defendant's Internet Service Provider. Plaintiff is entitled only to the name and address associated with the accused IP address, not the subscriber's email address or telephone number. Thompsons Film, LLC v. Does 1-60, No. 13 C 2368, 2013 WL 4805021, at *23 (N.D. Ill. Sept. 6, 2013); Purzel Video GmbH v. Does 184, No. 13 C 2501, 2013 WL 4478903, at *3 (N.D. Ill. Aug. 16, 2013); Bicycle Peddler, LLC v. Does 199, No. 13 C 2375, 2013 WL 4080196, at *3 (N.D. Ill. Aug. 13, 2013). Furthermore, the defendant will be allowed to proceed by pseudonym in this case. See Malibu Media, LLC v. John Does 1-6, 291 F.R.D. 191, 20607 (N.D. Ill. 2013); Purzel Video, 2013 WL 4478903, at *3 (citing TCYK, LLC v. Does 187, No. 13 C 3845, 2013 WL 3465186, at *4 (N.D. Ill. July 10, 2013)); Bicycle Peddler, 2013 WL 4080196, at *3. The court reserves the right to revisit this ruling at a later stage of this case. Plaintiff may not name the defendant publicly. It may not name the defendant in an amended complaint or any other public filing with the court. The defendant shall instead be identified by the pseudonym used in the complaint or IP address. Any communication by Plaintiff to the defendant suggesting that the defendant can or will be named in this action shall constitute a violation of this court's order and grounds for dismissal of the action pursuant to Rules 16(f)(1)(C) and 37(b)(2)(A)(v). September 27, 2018 Opinion or Order Filing 8 ORDER: Status hearing set for 11/28/2018 at 9:30 AM in Courtroom 2325. If, by the date of the scheduled status hearing, defendant has not been served, plaintiff should call the courtroom deputy (312-435-5641) to request a new status date. No status hearing should be held until all defendants have been served. Plaintiff is directed to advise the defendants of the status hearingforthwith.
