ORDER: The Court grants Plaintiff's application to proceed in forma pauperis #3 and Court orders the trust fund officer at Plaintiff's place of incarceration to deduct $14.39 from Plaintiff's account for payment to the Clerk of Court as an initial partial payment of the filing fee and to continue making monthly deductions in accordance with this order. The Court directs the Clerk to send a copy of this trust fund officer at the facility having custody over Plaintiff. The trust fund officer is directed to collect the filing fee in this matter and Plaintiff's two other concurrently filed cases as addressed below. Summons, however, will not issue at this time. The Court dismisses Plaintiff's complaint #1 for failure to state a claim. Plaintiff is given leave to submit a proposed amended complaint (assuming he believes that he can state a plausible claim). If Plaintiff fails to do so by December 17, 2018, the Court will dismiss this lawsuit. The clerk is directed to send Plaintiff an amended complaint form, one blank USM-285 (service) form, and instructions along with a copy of this Order. The Court advises Plaintiff that a completed USM-285 form is required for service on each Defendant named in the amended complaint. The U.S. Marshal will not attempt service on a Defendant unless and until the required form for that Defendant is received. A completed USM-285 form for each Defendant named therein should be submitted along with any amended complaint. Ruling on Plaintiff's motion for attorney representation #4 is deferred.
