Filing 3 ORDER: Plaintiff filed this suit without paying the $400 filing fee or submitting an in forma pauperis (IFP) application to pay the fee with monthly deductions form his jail or prison trust account. Under the Prison Litigation Reform Act (PLRA), an inmate must pay the filing fee for each case he files. See 28 U.S.C. 1915(b). If the inmate cannot prepay the fee, he must seek to proceed IFP, which if granted, will allow the trust fund officer at his facility to make monthly deductions from the inmate's account until the $350 fee is paid (a $50 processing fee is waived for IFP litigants). If Plaintiff wants to proceed with this case, he must first resolve the filing fee issue. By November 16, 2018, Plaintiff must either pay the $400 filing fee or submit a completed IFP application, with a certificate from an authorized officer at his facility and a copy of his jail or prison trust account for the six-month period before he filed his complaint. See 1915(a)(2). Plaintiff's failure to comply will result in summary dismissal of this case without prejudice. The Clerk of the Court shall forward an IFP application form to Plaintiff.
