Filing 9 ENTERED JUDGMENT on 1/25/2019. Notices mailed by judge's staff (ntf, ) |
Filing 8 ORDER. By order dated December 21, 2018 #6 , the Court noted that public records indicated that Plaintiff had been paroled, ordered Plaintiff to update his address, and directed him to either submit an updated in forma pauperis application or pay the full $400 filing fee. This order was sent to Plaintiff's address of record and was returned by the postal service #7 . The case opening letter sent to Plaintiff when he was in custody that advised him that he needed to update his address if it changed was also returned by the postal service #5 . Plaintiff has neither contacted the Court since his release nor responded to the Court's orders. Accordingly, this case is dismissed without prejudice based on Plaintiff's failure to comply with a Court order #6 . All pending motions are denied as moot. Having brought this action, Plaintiff remains obligated to pay the full filing fee. See 28 U.S.C. 1915(b)(1). A final judgment of dismissal shall enter. This case is closed. The Clerk is directed to send a copy of this order to Plaintiff's address of record on the docket (that is, the Stateville Correctional Center). Signed by the Honorable Jorge L. Alonso on 1/25/2019. Filing 6 ORDER: The U.S. Postal Service has returned mail sent to Plaintiff's address of record as undeliverable #5 . Although the Illinois Department of Corrections inmate locator indicates that Plaintiff was paroled on November 30, 2018, Plaintiff has not submitted a change-of-address notification. In light of Plaintiff's release from custody, by January 21, 2019, Plaintiff must submit a change-of-address notice with his current address. He must also either (1) submit a new application to proceed in forma pauperis with updated financial information or (2) pay the full $400 filing fee. If Plaintiff does not comply with all of these directives, this case will be summarily dismissed. The Clerk is directed to send Plaintiff a blank application to proceed in forma pauperis (for non-inmates), as well as a copy of this order, to Plaintiff's address of record on the docket (that is, the Stateville Correctional Center).
