ORDER: Plaintiff's renewed application for leave to proceed in forma pauperis #11 is granted. The Court orders the trust fund officer at Plaintiff's place of incarceration to deduct $9.60 from Plaintiff's account for payment to the Clerk of Court as an initial partial payment of the filing fee, and to continue making monthly deductions in accordance with this order. The Court directs the Clerk of Court to send a copy of this order to the trust fund officer of the facility having custody of Plaintiff. The complaint is dismissed without prejudice. Plaintiff has permission to submit an amended complaint that fixes the problems identified in this order. Any amended complaint is due by April 1, 2019. If no amended complaint is submitted, a final judgment will be entered dismissing the case without prejudice for lack of subject-matter jurisdiction and Plaintiff can pursue his claims in state court. ORDER: Plaintiff's application for leave to proceed in forma pauperis #3 is denied because it is incomplete. If Plaintiff wishes to pursue this litigation, by February 20, 2019, he must either (1) submit a completed in forma pauperis application that is certified by an appropriate jail or prison official or officials and includes a certified copy of his trust fund activity from the beginning date of his detention through the date of his application; or (2) pre-pay the full $400.00 statutory filing fee. Failure to do one of the foregoing by that date will result in dismissal of this case. The Clerk is directed to send a copy of this order to Plaintiff, along with an in forma pauperis application form.
