May 2, 2019 Filing 5 MINUTE entry before the Honorable Virginia M. Kendall. Plaintiff Carlos Salaman Jimenez's application for leave to proceed in forma pauperis #1 is denied without prejudice. His second application for leave to proceed in forma pauperis #3 is denied as duplicative. Title 28 U.S.C. 1915(a) permits the Court to authorize Plaintiff to proceed in forma pauperis if he is unable to pay the mandated filing fee. The statute "is designed to ensure that indigent litigants have meaningful access to the federal courts." Neitzke v. Williams, 490 U.S. 319, 324 (1989). Plaintiff is eligible to proceed in forma pauperis if paying the filing fee would prevent him from purchasing the necessities of life. Zaun v. Dobbin, 628 F.2d 990, 992 (7th Cir. 1980). Plaintiff represents in his affidavit that he is not married and has no dependents. (Dkt. 1.) Plaintiff is not currently employed and does not list any previous employment. (Id.) Plaintiff has not received any income or public benefits in the last year, he owns no real estate or personal property worth more than $1,000, and he has $250 in cash or in a checking or savings account. (Id.) Plaintiff did receive $25,200 from GUARDIAN INS LTD in the last 12 months. (Id.) Plaintiff must file an amended financial affidavit clarifying why he cannot pay the mandated filing fee with a portion of the $25,200 payment. Because the Court finds that Plaintiff has not yet sufficiently demonstrated that he is unable to pay the fee, his application for in forma pauperis status #1 is denied without prejudice. Plaintiff must file an amended financial affidavit by 5/7/2019. Plaintiffs second application for leave to proceed in forma pauperis #3 is denied as duplicative. Mailed notice (lk, )
