Date Filed Document Text
May 30, 2019 Filing 6 ENTERED JUDGMENT. Notices mailed. (psm, )
May 30, 2019 Filing 5 MINUTE entry before the Honorable Manish S. Shah: Plaintiff has submitted a complaint without paying the filing fee. The court assumes plaintiff seeks in forma pauperis status and as such, reviews the complaint under 18 USC s. 1915(e)(2) and the court's independent obligation to review the case for jurisdiction. Plaintiff's complaint appears to allege a medical malpractice claim against a private entity. There is no plausible allegation of a violation of federal rights by a state actor, and no apparent basis to conclude that this court has jurisdiction over a state-law claim for malpractice. The complaint is dismissed with prejudice for failure to state a federal claim for relief, and without prejudice for lack of subject-matter jurisdiction over state-law claims. Plaintiff may attempt to pursue malpractice claims in state court. The motion for attorney representation #3 is denied as moot. Enter judgment and terminate civil case. Notices mailed. (psm, )
May 15, 2019 Filing 4 NOTICE TO THE PARTIES - The Court is participating in the Mandatory Initial Discovery Pilot (MIDP). The key features and deadlines are set forth in this Notice which includes a link to the (MIDP) Standing Order and a Checklist for use by the parties. In cases subject to the pilot, all parties must respond to the mandatory initial discovery requests set forth in the Standing Order before initiating any further discovery in this case. Please note: The discovery obligations in the Standing Order supersede the disclosures required by Rule 26(a)(1). Any party seeking affirmative relief must serve a copy of the following documents (Notice of Mandatory Initial Discovery and the Standing Order) on each new party when the Complaint, Counterclaim, Crossclaim, or Third-Party Complaint is served.
