ORDER signed by the Honorable Edmond E. Chang. For the reasons stated in the Order, Plaintiff's applications to proceed in forma pauperis [8, 10] are granted in light of financial indigency. The Court orders the trust fund officer at Plaintiff's place of incarceration to immediately deduct $29.17 from Plaintiff's account for payment to the Clerk of Court as an initial partial payment of the filing fee in this case. Because Plaintiff owes filing fees in 10 cases, the Court also orders Plaintiff to pay (and the facility having custody of him to automatically collect and remit) to the Clerk of Court, ***100%*** of all deposits to Plaintiff's account until his filing fees have been paid in full. On screening review, the complaint #1 is dismissed for failure to state a claim on which relief may be granted. The federal claims are dismissed with prejudice. Any state law claims are dismissed without prejudice to Plaintiff filing a complaint in state court. This dismissal counts as one of Plaintiffs three allotted dismissals under 28 U.S.C. 1915(g). As explained in the Order, Plaintiff's motion for attorney representation #5 is denied. A separate AO-450 judgment shall be entered. Civil case terminate. Mailed notice(slb, )
