Filing 12 MINUTE entry before the Honorable Young B. Kim: Plaintiff's motion for summary judgment is due by November 25, 2019. The government's response and/or cross-motion for summary judgment is due by January 27, 2020. If Plaintiff believes that a reply is necessary, she may file a reply brief by February 10, 2020, but one is not required. Plaintiffs brief in support of reversing the final agency decision must include a section with a recitation of the relevant facts and a separate section identifying the statement of the issues presented in the brief. The statement of issues must set out a numbered list of issues for the courts consideration. The issue statement must also identify with specificity the aspects of the Commissioners final decision that Plaintiff challenges, along with a concise explanation of why Plaintiff believes the challenged aspects are unsupported by substantial evidence. Filing 7 MINUTE entry before the Honorable Virginia M. Kendall. Plaintiff Carl Nicholson's application for leave to proceed in forma pauperis #4 is granted. Title 28 U.S.C. 1915(a) permits the Court to authorize Plaintiff to proceed in forma pauperis if he is unable to pay the mandated filing fee. The statute "is designed to ensure that indigent litigants have meaningful access to the federal courts." Neitzke v. Williams, 490 U.S. 319, 324 (1989). Plaintiff is eligible to proceed in forma pauperis if paying the filing fee would prevent him from purchasing the necessities of life. Zaun v. Dobbin, 628 F.2d 990, 992 (7th Cir. 1980). Plaintiff has been unemployed since November 2008 when he stopped working at Jewel-Osco. (Dkt. #6 , pg. 1). He is not married, does not have more than $200 in cash or checking or savings accounts, and does not own any real estate. (Id. at pg. 3). Plaintiff does receive disability benefits from the Department of Veterans Affairs along with assistance from the Illinois Department of Human Services in the form of food stamps. (Id.). His grandson, Tre Nicholson, has lived with him for the past 16 years and depends on his grandfather for full support. (Id. at pg. 2). Payment of the filing fees in this action would substantially deplete the already minimal resources Plaintiff has to his name and would prevent him from purchasing the necessities of life. Considering the relevant factors, Plaintiff has sufficiently demonstrated that he is indigent and unable to pay the court fees and, therefore, grants him application to proceed in forma pauperis #4 .
