September 4, 2019 Opinion or Order Filing 7 ORDER: Plaintiff's application for leave to proceed in forma pauperis #3 is granted. The Court orders the trust fund officer at Plaintiff's place of incarceration to immediately deduct $2.92 from Plaintiff's account for payment to the Clerk of Court as an initial partial payment of the filing fee and to continue making monthly deductions in accordance with this order. The Court directs the Clerk of Court to send a copy of this order to the trust fund officer of the facility having custody of Plaintiff and to the Court's Fiscal Department. Following initial review pursuant to 28 U.S.C. 1915A, Plaintiff's complaint #1 is dismissed for failure to state a federal claim on which relief may be granted. In light of what appears to be Plaintiff's mistaken belief he can file a criminal complaint in this Court, the dismissal will not count as one of Plaintiff's three allotted dismissals under 28 U.S.C. 1915(g). The dismissal is without prejudice to Plaintiffs ability to pursue any related habeas claims in a proper forum. Final judgment shall enter, and all pending motions are denied as moot.
