The circumstances are ripe for a conference: the EEOC investigation did involve information exchange, Plaintiff is employed elsewhere at a roughly comparable salary, and the allegations in the complaint are resistant to a quick disposition. So in order to avoid the certain expense of discovery and motion practice, it is best to devote resources to resolving the case. In light of the referral, MID disclosures and discovery are stayed.
