December 20, 2019 Opinion or Order Filing 16 ORDER: Plaintiff's application for leave to appeal in forma pauperis #10 asks the Court to recruit counsel to represent him on appeal and his "motion" #11 asks for leave to appeal in forma pauperis. The Court denies Plaintiff's motion for attorney representation on appeal #10 without prejudice to renewal before the Court of Appeals, denies his application for leave to appeal in forma pauperis #11 , certifies that his appeal is not taken in good faith, and orders Plaintiff to pay the appellate fees of $505 within fourteen days. If he fails to do so, the Court of Appeals may dismiss his appeal for want of prosecution. If Plaintiff wants to contest this Court's finding thatthe appeal is not taken in good faith, he must file a motion with the Court of Appeals seeking review of this Court's certification within thirty days of service of this order. November 26, 2019 Opinion or Order Filing 7 ORDER: Plaintiff's application for leave to proceed in forma pauperis #3 is granted. The Court orders the trust fund officer at Plaintiff's place of confinement to deduct $19.17 from Plaintiff's account for payment to the Clerk as an initial partial payment of the filing fee, and to continue making monthly deductions as detailed in this order. The Clerk is directed to send a copy of this order (electronically if possible) to (1) the trust fund officer at the Metropolitan Correctional Center and (2) the Court's Fiscal Department. Following initial review, Plaintiff's complaint #1 is dismissed for failure to state a claim on which relief may be granted. The dismissal counts as one of Plaintiff's three allotted dismissals under 28 U.S.C. 1915(g). Plaintiff's motion for attorney representation #4 is denied as moot; the Court adds that recruitment of counsel would not have helped Plaintiff as with or without counsel, his claims fail as a matter of law.
