Filing 5 ORDER: Plaintiff's application for leave to proceed in forma pauperis #3 is denied without prejudice. If Plaintiff wants to proceed with this case, he must file an amended in forma pauperis application that accurately discloses the total amount of gifts that he received. Specifically, the amended application must disclose the gifts that he received from October 29, 2018 (that is, twelve months before initiating this action) through the day that he files a renewed in forma pauperis application. He also must disclose in detail how he spent his money, and explain why he believes his income should not be counted against his ability to prepay the full filing fee. Alternatively, Plaintiff may forego his request to proceed in forma pauperis and prepay the $400 filing fee. Either way, he must submit a sworn written statement addressing inaccurate statements in his current in forma pauperis application, as discussed below. If Plaintiff does not comply with all of these directives by February 18, 2020, the Court will dismiss this case. In the meantime, Plaintiff's motion for attorney representation #4 is denied without prejudice as he has not attempted to obtain counsel himself. See Pickett v. Chicago Transit Auth., 930 F.3d 869, 871 (7th Cir. 2019) (citing Pruitt v. Mote, 503 F.3d 647, 654 (7th Cir. 2007) (en banc)). Nothing suggests that Plaintiff is unable to respond to this Order without counsel, which calls for basic financial information and explanations about matters that are within his knowledge. Finally, Plaintiff must promptly submit a change-of-address notification if he is released or transferred to another facility. If he does not keep the Clerk apprised of his correct address, this case will be subject to dismissal. Signed by the Honorable Robert W. Gettleman on 1/8/2020. Mailed notice (cn). |
