January 29, 2020 Filing 15 MINUTE entry before the Honorable Manish S. Shah: Plaintiff has filed a new application to proceed in forma pauperis #14 . This court denied plaintiff's first application and ordered plaintiff to pay the filing fee by 12/27/19. Plaintiff did not pay the fee and the court dismissed the case without prejudice for failure to pay the fee. In plaintiff's new application, he has revised his statement of income and assets, but there is no reason to believe plaintiff's first application was not truthful. That first application revealed sufficient assets to pay the filing fee (including $7000 in cash or checking or savings accounts). Plaintiff was able to pay the fee in November and December 2019, and there is no reason to revisit the court's ruling. The new application #14 is denied. This case remains closed. Notices mailed. November 26, 2019 Filing 8 MINUTE entry before the Honorable Manish S. Shah: Plaintiff's application to proceed in forma pauperis #4 is denied. Plaintiff has sufficient assets to pay the filing fee. Plaintiff's motion for attorney representation #5 is denied. Plaintiff has not described any efforts to find counsel on his own, and the court will not recruit an attorney for plaintiff until plaintiff has tried to find an attorney. If unsuccessful, plaintiff must describe the reasons why he was unable to find an attorney. The court notes that there is no right to counsel in this type of lawsuit, and plaintiff has a post-graduate education. He is able to manage the early stages of litigation, so recruitment of counsel is not necessary. The complaint #1 is dismissed without prejudice. Although plaintiff checked the boxes to allege discrimination on the basis of color, disability, national origin, race, and religion, the allegations attached to the form do not adequately allege how the difficulties plaintiff experienced in the workplace were based on these protected characteristics. In addition, many of the accusations (such as increased scrutiny of work) are not adverse employment actions that can be the basis for a federal discrimination lawsuit. There are some allegations on page 10 that relate to disability, but the retaliatory action seems to be about the use of a laptop (and as a result, it is not clear that the response would chill protected activity). A complaint need only provide a short and plain statement of the claim. It should state simply what adverse action was taken against plaintiff, when, and why plaintiff believes color, disability, national origin, race, or religion was the reason for the adverse action. To proceed with this lawsuit, plaintiff must pay the $400 filing fee and file an amended complaint by December 27, 2019. Failure to pay the fee and file an amended complaint will result in the dismissal of the case. If plaintiff pays the fee and files an amended complaint, then plaintiff is also responsible for serving the summons and complaint on the defendant. Plaintiff may wish to consult the court's website for further information about representing himself, and may also make an appointment with the court's self-help assistance program. Notices mailed.
