January 28, 2020 Opinion or Order Filing 6 ORDER: On December 27,2019, Plaintiff initiated this 1983 civil rights lawsuit, in which he alleges unconstitutional conditions of confinement at Stateville. More specifically, Plaintiff claims that in 2017, he was confined in a cell that was "infested with cockroaches," and that, on December 22, 2017, a cockroach "crawled inside his right ear." [Dkt. #1 at pgs. 9-10.] Plaintiff names Stateville Warden Randy Pfister as Defendant in this action. [1d. at pg. 1.] The Court, on its own motion, dismisses this action as duplicative of Plaintiff's earlier-filed case (Anderson v. Pfister, et al., case no. 18 C 0627 (N.D. Ill.) (Norgle, J.) (alleging unconstitutional conditions of confinement at Stateville, including allegation that, on December 22, 2017, Plaintiff was watching tv when a roach crawled into his ear; complaint accepted and summons issued 6/1/18 for Defendants Pfister, Nicholson, Williams, Daly and Tanner)). Plaintiff's allegations in the instant lawsuit are already being litigated in case no. 18 C 0627. The Court therefore directs the Clerk to administratively close this case. Plaintiff's application for leave to proceed in forma pauperis #3 and his motion for attorney representation #4 are denied as moot. Civil case closed. Signed by the Honorable Charles R.
