Filing 10 ORDER ORDER Fourth Amended General Order 20-0012 IN RE: CORONAVIRUS COVID-19 PUBLIC EMERGENCY Signed by the Chief Judge Rebecca R. Pallmeyer on May 26, 2020. This Order does not extend or modify any deadlines set in civil cases. For non-emergency motions, no motion may be noticed for presentment on a date earlier than July 15, 2020. See attached Order. Signed by the Honorable Rebecca R. Pallmeyer on 5/26/2020: Mailed notice. (docket10, ) |
Filing 9 RECEIVED Complaint and no copies by Cordell Williams (Exhibits). (aee, ) |
MAILED Copy of Order dated 4/27 and an amended complaint form and instructions to Plaintiff. Copy of Order dated 4/27 to the trust fund officer at Plaintiff's place of incarceration. (aee, ) |
Filing 8 DECLARATION of Cordell Williams in support of Plaintiff's motion for partial summary judgement (Exhibits). (aee, ) |
Filing 6 ORDER: Plaintiff's application for leave to proceed in forma pauperis #3 is granted. The Court orders the trust fund officer at Plaintiff's place of incarceration to deduct $11.18 from Plaintiff's account for payment to the Clerk of Court as an initial partial payment of the filing fee and to continue making monthly deductions in accordance with this Order. The Court directs the Clerk of Court to send a copy of this Order to the trust fund officer at Plaintiff's current place of incarceration and to this court's fiscal department. Summonses, however, shall not issue. Plaintiff's complaint #1 is dismissed without prejudice for failure to state a claim. If Plaintiff wants to proceed with this lawsuit, he must submit an amended complaint that states a federal claim against proper defendants. Failure to submit an amended complaint by May 29, 2020, will result in dismissal of this lawsuit for failure to state a claim. Plaintiff also is advised that he must promptly submit a change-of-address notification if he is transferred to another facility or released. If Plaintiff fails to keep the Court informed of his address, this action will be subject to dismissal for failure to comply with a Court order and for failure to prosecute. The Court denies Plaintiff's motion for attorney representation, which shows that he has contacted only two law firms and, as such, has not made reasonable effort to obtain counsel on his own. See Pruitt v. Mote, 503 F.3d 647, 654-55 (7th Cir. 2007) (en banc); Russell v. Bukowski, 608 Fed. App'x 426, 428 (7th Cir. 2015) ("[B]efore a district court is required to consider recruiting counsel to assist a litigant in a civil case, the litigant must make a reasonable attempt to secure counsel for himself."). The Clerk of Court is directed to send Plaintiff an amended complaint form and instructions along with a copy of this Order. Signed by the Honorable Steven C. Seeger on 4/27/2020. Mailed notice.
