ORDER :Plaintiff's application for leave to proceed in forma pauperis #3 is granted. The Court orders the trust fund officer at Plaintiff's place of incarceration to deduct $17.55 from Plaintiff's account for payment to the Clerk of Court as an initial partial filing fee and to continue making monthly deductions in accordance with this order. The Court directs the Clerk of Court to send a copy of this order (electronically if possible) to the trust fund officer at Plaintiff's place of incarceration and to this court's fiscal department. Summonses, however, shall not issue. Plaintiff's complaint #1 is dismissed without prejudice for failure to state a claim on which relief can be granted. The Court grants Plaintiff until December 3, 2020, to submit an amended complaint that states a federal claim against proper defendants. If Plaintiff does not comply with this order, the Court will dismiss this lawsuit with prejudice for failure to state a claim. Plaintiff also must promptly submit a change-of-address notification if he is transferred to another facility or released. If Plaintiff does not keep the Court informed of his address, this lawsuit may be subject to dismissal for failure to comply with a court order and for failure to prosecute. Plaintiff's motion for attorney representation #4 , is denied without prejudice. The Clerk is directed to send Plaintiff an amended civil rights complaint form along with a copy of this order.
