May 4, 2021 Opinion or Order Filing 7 MINUTE entry before the Honorable Edmond E. Chang: The Court's Case Management Procedures requires all motion to contain a statement of conferral. The defense motion #6 to set a response deadline fails to do so. The motion is denied. In any event, the answer deadline is suspended because the Court poses the following jurisdictional inquiry, which must be addressed first. The Defendants premise jurisdiction on diversity of citizenship, 28 U.S.C. 1332. But the complaint appears to contest the validity and substance of one or more wills and seeks to enforce a divorce decree. R. 1, Notice of Removal, Exh. A, Complaint paras 3, 12, 17-18. The subject matter of the suit, and the relief sought, raise a serious concern that the domestic-relations or probate exceptions (or both) to federal diversity jurisdiction apply, which would render improper the removal to federal court. See Ankenbrandt v. Richards, 504 U.S. 689, 695-97 (1992) (domestic-relations exception); Friedlander v. Friedlander, 149 F.3d 739, 740 (7th Cir. 1998) (domestic-relations exception); Marshall v. Marshall, 547 U.S. 293, 310-12 (2006) (probate exception); Jones v. Brennan, 465 F.3d 304, 306 (7th Cir. 2006) (probate exception). By 05/18/2021, the Defendants shall file a Jurisdictional Memorandum explaining why subject matter jurisdiction applies. By 06/07/1021, the Plaintiffs shall file a Response to Jurisdictional Memorandum, staking out a position on it. The defense may reply by 06/21/2021.
