July 9, 2021 Filing 6 MINUTE entry before the Honorable Sharon Johnson Coleman: In the present habeas petition, Valentina O'Connor, on behalf of her son Michael O'Connor, challenges a June 2017 conviction and June 2021 ruling in the Circuit Court of Cook County. She also explains that Michael has been incarcerated at the Cook County Jail since March 12, 2021. In the petition, O'Connor states that the Illinois Appellate Court dismissed the appeal and admits that the Illinois Supreme Court clerk explained that the appeal was not properly filed with the court. Accordingly, the Court dismisses O'Connor's habeas petition because O'Connor has failed to properly exhaust his claims. Furthermore, as in Michael O'Connor's earlier lawsuit, Valentina has not shown that she has authority to act on behalf of her son as his guardian. Thus, she does not have standing to bring a lawsuit on his behalf. See Cabral v. City of Evansville, 759 F.3d 639, 642 (7th Cir. 2014). The Court therefore dismisses this lawsuit #1 and denies the motion for attorney representation #4 and motion for reassignment #5 as moot. Civil case terminated. Mailed notice. (ym, )
