Filing 13 ORDER: Despite a Castro v. United States warning not being required in this case as Petitioner is represented by counsel while Castro applies to pro se cases, 540 U.S. 375, 384 (2003), Judge Feinerman, who was assigned this case upon filing, prudently provided the Castro warning. (Dkt. 10.) Hazley has not objected to Judge Feinerman's classification of this case as a 28 U.S.C. 2255 proceeding so the Court proceeds with an understanding that Hazley desires to bring a 2255 motion and that he has raised all desired claims in this action. The government is ordered to respond to the amended 2255 motion and memorandum in support [8, 9] by October 29, 2021. Hazley shall reply by November 19, 2021. As this is a 2255 proceeding, the Clerk shall update the docket to reflect that United States of America is the Plaintiff, and Joseph Hazley is the Defendant-Movant. Respondent Michael Segal is terminated from this case as an improperly named party. The Clerk shall alter the case caption to United States v. Hazley. Filing 10 MINUTE entry before the Honorable Gary Feinerman:Given the filing of an amended petition #8 , the Clerk is directed to terminate the original petition #1 as a pending petition. The amended petition (Dkt. 8 at pp. 16-17) and the supporting memorandum (Dkt. 9 at pp. 13-14), which were filed by able counsel, make clear that Petitioner intends to proceed under 28 U.S.C. 2255. Accordingly, the Clerk is directed to change the Nature of Suit from 530 to 510. In an excess of caution, the court admonishes Petitioner that: (1) it is characterizing his petition as a 28 U.S.C. 2255 motion; (2) that the Section 2255 motion will be subject to the limitations on "second and successive" 28 U.S.C. 2255 motions; and (3) he may withdraw the petition or amend it so that it can contain all claims he desires to raise in a Section 2255 motion. If Petitioner did not intend to bring his petition under 28 U.S.C. 2255, he should quickly file a memorandum to that effect. Finally, the Clerk is directed to reassign this case to the Executive Committee for consideration of whether it should be directly assigned to District Judge Coleman.
