Chang: On review of the motion #1 to quash subpoena filed by Trustmark, the Court first notes that the miscellaneous-case filing fee has not yet been paid. If Trustmark needs more information on amount of the filing fee or how to pay it, then it should contact the Clerk's Office. Second, it might make a great deal of sense to transfer this motion to the issuing court, that is, the Southern District of Florida, under Federal Rule of Civil Procedure 45(f). The presiding court will have a much, much better handle on the discoverability of the information and records sought, and its importance to the proposed class action. And with remote appearances now commonplace and cost-effective, typically there is no downside involved in litigating the dispute in the issuing court. On or before 10/01/2021, Trustmark and the subpoena issuer (South Broward Hospital District) shall set forth their respective positions in Position Papers on a transfer to the issuing court. To track the case only, a status hearing is set for 10/08/2021 at 8:30 a.m., but to track the case only (no appearance is required, the case will not be called).
