Consistent with the purpose of the Federal Rules "to secure the just, speedy, and inexpensive determination of every action and proceeding," Fed. R. Civ. P. 1, this Court's Standing Order requires the pleading party to make an election as to whether it will amend its pleading or stand on the current pleading and proceed with briefing on the motion to dismiss. To this end, Defendant shall, by 12/27/21, file either an amended answer/affirmative defenses or a response to the motion to dismiss. MINUTE entry before the Honorable John Robert Blakey: Based upon the representations in the parties' 11/29/21 status report #12 , the Court sets case management dates as follows: the parties shall exchange Rule 26(a)(1) disclosures by 12/10/21, issue written discovery by 1/7/22, amend their pleadings (to add claims, parties, etc.) by 3/31/22, and complete fact discovery by 6/30/22. The parties indicate in their status report that they may wish to pursue summary judgment before expert discovery. Absent sufficient cause, however, the Court does not normally permit piecemeal summary judgment briefing, and would adopt the parties' proposal only if the parties represent that they would not anticipate seeking a second bite at the summary judgment apple after expert discovery. The parties shall file an updated status report by 6/1/22 confirming that they are on track to meet the 6/30/22 fact discovery deadline, indicating whether any party in fact will seek summary judgment, and addressing the question of whether their proposed schedule contemplates two rounds of dispositive motions. The Court appreciates that the parties are not interested in a settlement conference at this time, but nonetheless encourages them to exhaust the possibility of settlement before spending time and money on dispositive motions and expert discovery. If at any time the parties agree that a settlement conference with the assigned Magistrate Judge could be productive, they should call chambers to so advise, and the Court will enter an appropriate referral order.
