MINUTE entry before the Honorable John Robert Blakey: Based upon the representations in the parties' 11/29/21 status report #16 , the Court sets case management dates as follows: Plaintiff shall file the proposed second amended complaint by 12/22/21, and Defendants shall answer or otherwise respond by 1/14/22; the parties shall exchange Rule 26(a)(1) disclosures by 1/10/22, issue initial written discovery by 2/10/22, amend their pleadings (to add claims, parties, etc.) by 6/1/22, and complete fact discovery by 8/10/22; the parties shall file an updated status report by 7/22/22 indicating whether they in fact require expert discovery and whether any party will in fact seek summary judgment. If at any time the parties agree that a settlement conference with the assigned Magistrate Judge could be productive, they should call chambers to so advise, and the Court will enter an appropriate referral order. Based upon the representation that Plaintiff will be filing a second amended complaint, the Court denies without prejudice Defendant's motion to dismiss #13 and vacates the briefing schedule #15 . If Plaintiff pleads the same count in its second amended complaint, Defendant may re-file its motion as appropriate, and the Court will set a revised briefing schedule. Mailed notice (gel, )
