Shah on 4/5/2022: By order of Feb. 18, 2022, the Court denied Plaintiff's in forma pauperis application without prejudice because it was incomplete and not on this Court's required form. Plaintiff was given until March 18, 2022, to submit a properly completed application or pre-pay the $402.00 filing fee. Plaintiff was warned that failure to do so would result in summary dismissal of this case #7 . Although Plaintiff has attended to another pending case before this Court, Miller v. Gomez, No. 20 C 0779, he has not complied with his filing-fee obligations in this case. The Court therefore dismisses this case without prejudice. See LR 3.3(f) (dismissal of case for failure to pay filing fee is allowable sanction); see also Dietz v. Bouldin, 579 U.S. 40, 47 (2016) ("district courts have the inherent authority to manage their dockets and courtrooms with a view toward the efficient and expedient resolution of cases"); Anderson v. Williamson, 748 F. App'x. 710, 711 (7th Cir. 2019) (unpublished) (dismissal without prejudice is appropriate disposition where plaintiff fails to satisfy the filing-fee requirements). February 18, 2022 Filing 7 MINUTE entry before the Honorable Manish S. Shah: Plaintiff initiated this pro se lawsuit while in custody and without pre-paying the $402.00 filing fee or submitting an in forma pauperis application. Plaintiff has since been released from custody. The Court directed Plaintiff to submit a properly completed IFP application showing his current financial and employment status and with copies of his prison trust fund statements showing activity in his trust fund account for the six-month period preceding the filing of this lawsuit, or from approximately April 21, 2021, through Oct. 21, 2021. Plaintiff has submitted an in forma pauperis application #6 using another court's form and which does not disclose any means of support other than "$13 per month from state and inconsistent donation." See #6 at pg. 2. It is unclear if the $13 per month refers to state pay Plaintiff received while in prison, and it is unclear what he means by "inconsistent donation" or how he is supporting himself after his release from custody. Plaintiff also has not submitted the required trust fund statements. The Court denies Plaintiff's in forma pauperis application #6 without prejudice to Plaintiff submitting a renewed application, on the Court's required form, that explains his current means of support, along with the required trust fund statements. Alternatively, Plaintiff may pre-pay the $402.00 filing fee. Failure to take either action by 3/18/22 will result in summary dismissal of this action. December 28, 2021 Opinion or Order Filing 5 ORDER: Plaintiff initiated this pro se lawsuit while in custody and without pre-paying the $402.00 filing fee or submitting an in forma pauperis application. The Court directed Plaintiff to either pre-pay the filing fee or submit a properly completed IFP application by Jan. 7, 2022. #3 . The Court has since learned that Plaintiff has been released from custody. Because Plaintiff filed this lawsuit while in custody, Plaintiff is responsible for payment of the full filing fee. See Robbins v. Switzer, 104 F.3d 895, 89798 (7th Cir. 1997) (citing 28 U.S.C. 1915(b)(1)). If he wants to proceed with this case, Plaintiff must either pre-pay the filing fee or submit a properly completed IFP application that shows his current financial and employment status so that the Court can determine his current ability to pay the filing fee. See id. at 898.Plaintiff also must submit copies of his prison trust fund statements showing activity in his trust fund account from approximately April 21, 2021, through Oct.21, 2021, from any facility in which he was detained during that time. See id. The Court extends the deadline for compliance to Jan. 20, 2022. Failure to satisfy the filing-fee requirements by that date will result in summary dismissal of this action.
