July 21, 2022 Filing 9 MINUTE entry before the Honorable Martha M. Pacold: Plaintiff shall serve defendants with this order. The court has reviewed Plaintiff's motion for entry of default and default judgment #7 , as well as Plaintiff's notice of motion #8 . The notice of motion and associated hearing are stricken. The court's motion procedures, which are posted on the court's website, prohibit the noticing of motions at this time. Moreover, although Plaintiff calls the motion a "Motion for Order of Default and Judgment in Sum Certain," the court construes the motion as a request for entry of default pursuant to Federal Rule of Civil Procedure 55(a), because default judgment is generally not appropriate until after Plaintiff has sought and obtained an entry of default. See In re Catt, 368 F.3d 789, 793 (7th Cir.2004) ("There are two stages in a default proceeding: the establishment of the default, and the actual entry of a default judgment. Once the default is established, and thus liability, the plaintiff still must establish his entitlement to the relief he seeks."). So construed, the court takes the motion #7 under advisement, and will enter default against defendant if defendant does not appear and file a response by 8/4/2022. (rao, )
