ORDER: Petitioner Tyrese Crawford initiated this 28 U.S.C. 2254 habeas petition pro se challenging his conviction of first-degree murder. He seeks leave to proceed without payment of the $5.00 filing fee. For several reasons, the Court denies Crawford's application for leave to proceed in forma pauperis #3 . Although Crawford printed his name, he did not sign his application. Nor did he have a trust fund officer at Stateville Correctional Center certify his application. And he omitted the amount of income he receivesboth in deposits by others and payroll earnings. More importantly, his trust fund account statement shows that he has an ability to pay the filing fee.1 He must pay the $5.00 filing fee to proceed with this case, which he may do by check or money order made payable to Clerk, United States District Court, Northern District of Illinois. Crawford's failure to comply with this order by October 3, 2022, will result in summary dismissal of this habeas action without prejudice. See LR 3.3(f). The Court also denies without prejudice Crawford's motion for appointment of counsel #4 . Counsel is recruited in habeas proceedings for evidentiary hearings or if justice so requires. See Rule 8(c) of the Rules Governing 28 U.S.C. 2254 Cases. The need for counsel typically cannot be made until after a response to the habeas petition has been filed.
