ORDER: Kane County detainee Anthony L. Smith initiated this lawsuit under 42 U.S.C. 1983, but he did not pay the Court's filing fee or apply for leave to proceed in forma pauperis. Plaintiff is given until February 3, 2023 to either (1) submit a properly-completed application to proceed in forma pauperis on the accompanying form along with a certified copy of his trust fund account statement showing all transactions to his account for the six-month period immediately preceding his initiation of this lawsuit; or (2) pre-pay the $402.00 filing fee. Failure to comply by February 3, 2023 will result in dismissal of this lawsuit. Plaintiff should be aware that waiver of the fee is not an option. Thus, if he is granted leave to proceed in forma pauperis, he must pay the filing fee over time in installments consisting of 20% of his monthly income (including money sent by family and friends) until the filing fee is paid in full. This obligation will continue even if he is transferred to another facility and even if this case is dismissed. The Court defers consideration of Plaintiff's complaint under 28 U.S.C. 1915A until after his fee status is resolved. The Clerk of Court is directed to send Plaintiff a blank application to proceed in forma pauperis and a copy of this order. Signed by the Honorable Matthew F.
