Parties reported that they wish to exchange written discovery and then determine whether a settlement conference would be useful. Written discovery will generally pertain to damages and the claim file from the insurance company. Defense counsel also noted that there is an exclusion clause in the insurance policy that will require discovery into plaintiff's maintenance of certain pipes. The Court set the following discovery deadlines: Rule 26(a)(1) disclosures to be made by 2/24/23; motion for protective order to be filed by 2/24/23; written discovery to be issued by 3/10/23. The Court noted that written discovery issued after 3/10/23 is only permissible by joint agreement of the parties or by requesting leave of court. Status hearing set for 4/25/23 at 9:15 a.m. Joint status report to be filed by 4/21/23, addressing: the status of written discovery; whether there are any disputes in written discovery that will require motion practice (if so, the parties must have engaged in a Rule 37 conference PRIOR to the status hearing); whether the parties wish to participate in a settlement conference, or would prefer to complete depositions first; and any other issues the parties wish to raise with the Court.
